Limited Liability Indemnity

This page sets out the limits of our liability and your indemnity obligations when you use Mould Removal Service (moldremovalservice.co), operated by BuyFactory Direct Pty Ltd (ABN 30 656 628 938) ("we", "us", "our"), or buy our products. It forms part of our Terms & Conditions and does not affect your rights as a consumer.

1. Your consumer guarantees come first

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded, including your rights under that law. Where those rights apply, they take priority over anything stated here.

2. Limitation of our liability

Subject to the section above, and to the fullest extent permitted by law:

We are not liable for any indirect or consequential loss, or for loss of profit, revenue, data or goodwill, however it arises.
We are not liable for loss or damage caused by misuse of a product, by failure to follow the product label, safety directions or manufacturer instructions, or by normal wear and tear.
Where we are liable, our total liability to you for any claim connected with an order is limited, where the law allows, to re-supplying the product or paying the cost of doing so.

3. Product use is at your risk

Our products include cleaning chemicals and personal protective equipment (PPE). You are responsible for using them safely. Always read the product label and safety directions before use, wear the recommended PPE, keep products away from children and pets, and store and dispose of them as directed. We are not liable for loss, injury or damage caused by use that does not follow these directions.

4. Website availability

We try to keep the site available and working, but we do not guarantee uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice, and, to the extent permitted by law, we are not liable if it is unavailable at any time.

5. Your indemnity

To the extent permitted by law, you agree to indemnify us against any reasonable loss, cost or claim we suffer as a result of your breach of our Terms & Conditions, your misuse of a product, or your misuse of the website.
